The licensee’s address is incorrect on his license. The road should be “ALEMBIC”, not “ALEMBIE”. The licensee submitted a statement (Source Documents - 2. FFL Correction) during the inspection requesting his license be amended to the correct address. ALTERNATE RECOMMENDATION : The inspection results merit a Warning Conference according to condition 6.d.(6) of the current ATF Adverse Action Policy. An alternate recommendation of a Warning Letter with no recall inspection is recommended due to the licensee's receptiveness to corrective action and his low-volume of business activity.
ALTERNATE RECOMMENDATION : WARNING LETTER ONLY - NO RECALL The inspection meets the standard for a Warning Conference under the Administrative Action Policy (2/8/2013). The licensee was cited for redacted instance of failing to record any ID on the Form 4473 (33%) - Warning Conference at Sec 6 d.(6). JUSTIFICATION FOR ALTERNATE: The violation does not appear willful in nature. The licensee is a low-volume dealer/gunsmith. No firearms were in inventory. The inspection scope was expanded to a 3-year period, as there was no activity in the 12 months prior to the inspection. In that 3-year scope, the licensee had only 3 forms on file. Licensee was receptive to the corrective action and educated on the proper completion of the form.
