A Report of Violations was issued and a Warning Letter (no recall ) is recommended in lieu of a Warning Conference, due to the following mitigating factors: (1) Violation of 27 CFR 478.21 (a) is a repeat violation; however, the licensee reduced the number of instances from redacted during the previous inspection, to redacted instances (less than 1% of the 676 forms reviewed) during this inspection period. (2) Violation of 27 CFR 478.124(c)(1) is a repeat violation; however, the licensee reduced the number of instances from redacted during the previous inspection, to redacted instances (less than 1% of the 676 forms reviewed) during this inspection period. (3) Violation of 27 CFR 478.102(a) is a repeat violation; however, the licensee reduced the number of instances from redacted during the previous inspection, to redacted instance (less than 1% of the 676 forms reviewed) during this inspection period. (4) Violation of 27 CFR 478.126a is a repeat violation; however, the licensee reduced the number of instances from redacted during the previous inspection, to redacted instance during this inspection period. (5) Licensee’s recordkeeping has drastically improved, as evidenced by the reduction in the total number of violations from 27 during the previous inspection, to 4 violations cited as a result of this inspection. (6) Licensee prepared and has instituted a written internal controls policy since the previous inspection. The policy requires that at least redacted employees review ATF Forms 4473 prior to transferring a firearm, and that the employee conducting the second review must initial the form, indicating that the review was conducted. The policy also provides for a “Firearms Operations Manager” responsible for the day-to-day operations related to firearms, and an “Internal Auditor” responsible for conducting weekly reviews and filing of all forms.

The FFL has shown a great improvement since the previous inspection. On the previous inspection, the FFL had a totla of 27 violations. The current inspection resulted in 4 violations of which all were repeat, howver the amount of each violation was greatly reduced. Since the last inspection, the FFL has implemented a policy to ensure that each transaction is verified by another employee, the forms are reviewed by another employee, and the FFL conducts an inventory of the firearms every quarter. It appears that the FFL took the results of the previous inspection very seriously and took action to ensure the violations would not be repeated. I concur with the IOI recommendation for a Violations, Warning Letter and no Recall Inspection of this FFL.
Concur with recommendation of a WL ILO WC based on the reduction in the number of violations and the number of forms involved. Only two of the four violations warrant an administrative action of a WL for 27 CFR 478.102(a)(1) and 478.126a.
