According to the ATF Order 5370.1, a Warning Conference is warranted due to the cited violation of 27 CFR 478.124(c)(3)(i) and this violation being a repeat violation which previously resulted in a Warning Conference held October 15th 2009 (more than five years ago). During this inspection, there were redacted ATF Forms 4473 which were affected because the Licensee failed to document and or failed to record a qualifying response to Section B Item 20b. Alternate Documentation. The Licensee has decreased the number of forms affected from redacted Forms (June 5th 2009) down to redacted Forms with similar errors and omissions. There has also been a period of six years and four months since the Warning Conference was held with the Licensee which is the last applicable Administrative Action . Although the Licensee was also cited for repeat violations of 27 CFR 478.125(e) and 27 CFR 478.124(c)(1) as a result of this inspection, neither violation rises to the level of Warning Letter, Warning Conference or Revocation. It is based upon the above mentioned circumstances that an alternate recommendation of Viols WL ONLY and NO Recall Inspection is being made.

I concur with the recommended Alternate Recommendation for Viols WL ONLY and No Recall Inspection. It has been over six years since the FFL attended a Warning Conference and has show improvement by reducing the number of violations that related to the records and forms.
DIO concur with the recommendation of a WL Only and No Recall Inspection based on the repeat violation of 27 CFR 478.124(c)(3)(i) for the failure to properly complete item 20b of the ATF Form 4473 by obtaining alternate documentation, on redacted forms. This violation is a reduction from the instances that occurred during the field investigation in 2009, and there is an overall reduction in the number of violations cited during the current investigation, which was redacted from redacted in 2009.
