Conduct initial compliance inspection of this type 07 FFL . Referral received by WFD Intel relating to FFL selling multiple handguns and not completing requisite multiple sales forms. NOTE: FFL expires 3-01-2017
IOI recommends the licensee receive a Warning Letter in lieu of attending a Warning Conference. During this inspection, IOI redacted found that the licensee transferred a lower receiver to an out-of-state resident, in violation of 27 CFR 478.99(a), on redacted instances. According to ATF O 5370.1C, this violation would generally merit a Warning Conference; however, IOI redacted recommends that the licensee receive a Warning Letter for the following mitigating circumstances. This is the first compliance inspection for this FFL . According to the responsible person , Robert Hall, he thought that receivers of long guns were treated as long guns and this logic was also followed when indicating the type of firearm when initiating a NICS check through the Virginia State Police Firearms Transaction Center. The FFL was able to reconcile all acquisition and dispositions and did not report any missing firearms. The FFL successfully completed redacted requests received during the previous 12 months. On April 19, 2017, IOI queried responsible persons Shahab ASHTIANI and Robert HALL in NCIC with no identifiable records returned. Both were queried in N-Force with no associated investigations found.
A/S concurs with alternate recommendation of Warning Letter with Recall in lieu of Warning Conference. FFL transferred a lower receiver to an out-of-state resident, in violation of 27 CFR 478.99(a), in redacted instances. Per ATF O 5370.1 C, this violation rises to the level of Warning Conference; however, IOI and A/S recommend the licensee receive an alternate recommendation of Warning Letter with recall inspection due to mitigating circumstances. This is the first compliance inspection for this FFL. According to the responsible person , Robert Hall, he thought that receivers of long guns were treated as long guns and this logic was also followed when indicating the type of firearm when initiating a NICS check through the Virginia State Police Firearms Transaction Center. The FFL was able to reconcile all acquisition and dispositions and did not report any missing firearms. The FFL also successfully completed redacted requests received during the previous 12 months. This FFL does not appear to represent a public safety threat at this time and a recall inspection will verify future adherence to GCA reguations.
