A recall compliance inspection ending on April 9, 2014 resulted in violations cited and a report of violations was issued. A warning conference was held on May 27, 2014 and follow up letter was sent on June 5, 2014. SWB DE Recall. Conduct a full scope compliance inspection. 12 months records review of ATF Forms 4473 is required. Address all applicable inspection procedures/guidelines identified by the current FY IO operating plan.
The licensee was cited for repeat violations of 27 CFR 478.102(a) for the failure to conduct a NICS check on redacted occasions, and 27 CFR 478.125(e) for the failure to record required acquisition and disposition information in an Acquisition and Disposition ( A&D ) Record redacted stances. The licensee was also cited for 27 CFR 478.124(a) for the failure to complete redactedTF Forms 4473 . redactedf the redactedirearms in each violation were consignment firearms returned to the consignor.
An alternate recommendation of Revocation is being made. The licensee had two prior jnspctions that resulted in warning conferences. The current inspection has also resulted in a recommendation of warning conference by IOI redacted. The majority of the violations being cited as a result of this inspection are repeat violations of the previous two inspections.
The licensee was cited for failing to conduct NICS background checks prior to t sfer of a firearm o redacted ansactions. On redactedf these transfers the licensee added firearms to previously completed forms. The othe redacted nsfers were consignments returns. The licensee was cited for this same violation in redacted revious compliance inspections (2013 and 2014) both resulted in Warning Conference. Therefore, I concur with the Area Superviso commendation of Revocation. On April 11, 2016, the Final Notice of Revocation (NOR) was delivered in-person to the licensee with an effective date of revocation on June 13, 2016. Response Person Curtis Manchester accepted and signed the Final NOR. On jun 13, 2016, all required records and the original license were obtain and will be mailed to the Out of Business Records Center.
