FY2017 DA MANDATORY RECALL COMPLIANCE (TYPE 01 FFL ) RESULTING FROM A DIO WC ** Must Be Completed By 03/01/2017 Please conduct a full compliance Recall Inspection at the licensed premises. As part of this inspection, please conduct the following activities: -Verify the business profile to ensure proper licensure -Explore ownership and control to include Deconfliction Queries -Conduct a full physical inventory in conjunction with an A&D Records Review. The inspection should focus on inventory and inventory controls as this was the licensee's primary issue during the previous Compliance Inspection. -Conduct a comprehensive review of ATF Form 4473s for the inspection period with a focus on suspicious purchasers worthy of referral to ATF CE -Ensure that all Multiple HG Sales are timely and accurately filed for the inspection period -Examine trace activity for the inspection period -Issue a ROV (if necessary) -Conduct a Federal Firearms Regulations Review with the RP -Make recommendations in accordance with the Adverse Action Plan

Ul# 766060-2017-0170-BIB FFL # 8-25-34978 Licensee: Bee, Kenneth Eugene dba Bee's Guns Dates of Inspection: 01/03/2017-02/17/2017 Scope of Inspection: Recall Compliance (Type 01 FFL) Time Frame of Inspection: 01/01/2016-12/31/2016 Recommendation: Viols ; ROV Only; No Recall SIOI: redacted A/S Comments: From 01/03/2017-02/17/2017, SIOI Petri conducted a Recall Compliance Inspection at the licensed premises of Kenneth Eugene Bee dba Bee’s Guns. As a result of this inspection, SIOI redacted cited the following three (3) Repeat Violations: 1. ) 27 CFR 478.125(e) REPEAT OF VIOLATION CITED ON 06/19/15 AND 09/27/13 Nature of Violation: In redacted instances, the licensee failed to record within 7 days in the A&D Records the disposition of a firearm to an unlicensed individual or the licensee’s personal collection. 2. ) 27 CFR 478.124(c)(1) REPEAT OF VIOLATION CITED ON 06/19/15 AND 09/27/13 Nature of Violation: In redacted instances out of 1,694 forms examined, the licensee transferred a firearm without obtaining complete and accurate information from the transferee in Section A. 3. ) 27 CFR 478.21(a) REPEAT OF VIOLATION CITED ON 06/19/15 AND 09/27/13 Nature of Violation: In redacted instance out of 1,694 forms examined, transferee answered a Section A question incorrectly and transferor failed to stop the transfer. As a result of these violations and in accordance with the Adverse Action Policy, SIOI redacted has recommended, "Viols; ROV Only; No Recall." A/S Recommendation: Viols; ROV Only; No Recall for the following reasons: 1.) Significant improvement in inventory controls and A&D Record Book completion. In 2015 redacted instances of incomplete/inaccurate A&D Records were identified resulting in redacted missing firearms. For the current inspection redacted instances of incomplete/inaccurate A&D Records were identified resulting in NO missing firearms for a Deficiency Rating of less than 1% 2.) Low Deficiency Ratings related to completion of ATF Form 4473s . The ATF Form 4473 Deficiency Ratings were less than 1%. NCIC queries on purchasers who were the subject of the deficient ATF Form 4473s did NOT reveal any proh biting information 3.) No missed Multiple HG Sales. As a result of the 2015 Compliance Inspection, the licensee failed to report redacted Multiple HG Sales involving redacted firearms. For the current inspection, the licensee reported all Multiple HG Sales in a timely and accurate manner. 4.) Implementation of SOPs related to inventory. The licensee has placed Manager, Mike McKnight, in charge of recordkeeping. According to the Narrative Report, since the previous WC , the Mr. McKnight is conducting inventories on a monthly basis resulting in no missing firearms. Additionally, Mr. Bee seems to have appropriately separated all personal firearms from retail firearms in order to ease the burden of conducting a full physical, internal inventories. Finally, Mr. Bee and his employees have implemented a tag system to assist with tracking the inventory. 5.) Implementation of SOPs regarding Multiple HG Sales. The licensee has implemented SOPs regarding the tracking of HG sales in order to identify Multiple HG Sales to the same unlicensed individuals. The implementation of this SOP has resulted in NO unreported Multiple HG Sales. 6.) Not a threat to public safety. The licensee was the subject of redacted traces during the inspection period. NO suspicious purchasers/firearms were identified. For these reasons and in accordance with the AA Policy, ROV Only, No Recall is appropriate recourse. Narrative will be forwarded to the DIO for secondary review and final recommendation.
On this second Recall , compliance Investigation three (3) repeat violations were found (e g, unrecorded dispositions, and deficient Forms 4473 ), which due to the licensee’s compliance history, by policy, subjects the license to revocation if willful . However, in considration of Division Counsel's opinion, and in light of the negligible percentage error rate relative to the business volume, no missing firearms, no unresolved traces, nor evidence of trafficking/ straw sales , no dispositions to prohibited individuals, or apparent threat to the public safety, a WL in lieu of revocation is deemed appropriate to address the violations.
