On 2/1/2016, Investigators redacted along with Investigative Analyst redacted initiated an onsite Full Compliance Demand letter 2 Investigation at the licensee's premises. The period of inspection was 2/1/2015 through 1/31/2016. The investigators interviewed Mr. R. Brad Ramsey, owner/member and Ms . Jackie Elaine Rogers, manager. No other agencies participated in the inspection. No advance notification was given prior to the inspection. The inspection resulted in six (6) violations cited, which were: 27 CFR 478(c)(1); 27 CFR 478.124(c)(3)(i); 27 CFR 478.124(c)(3)(iv); 27 CFR 478.124(c)(5); 27 CFR 478.126a; and 27 CFR 478.125(e). Licensee is operating with an ATF “demand letter - 2” where licensee is required to report gun information on all firearms acquired from non-licensees. The data reported was reviewed and compared to the A&D during the investigation, and determined to be complete. No discrepancy was disclosed regarding licensee's compliance with the “demand letter”. redacted inventory was inspected with no discrepancey disclosed. Information in FLS is correct with no changes. There have been no changes in ownership or control.
Benton Shooters Supply LLC 1-62-139-01-6K-03253 redacted 2/1/16 I concur with the findings of this investigation. This FFL had a previous W/C under a previously held FFL, in 2007. Although this investigation disclosed violations that would warrant a W/C, based on number of Multiple Handgun Sale Forms not submitted. However, the number or violations disclosed are signifiantly fewer than those disclosed in 2007. I recommend a W/L based on the above information and that the FFL has put in place procedures to prevent future violations.
The DIO concurs with the recommendation of Warning Letter in Lieu of Warning Conference due to the fact that the number of instances in the one violation that warrants a warning conference was significantly lower than the previous inspection and the licensee has put additional internal controls into place to prevent thisd violations from recurring.
