Theft/Loss Investigation - Conduct joint investigation with the Yakima Field Office on the burglary of the FFL . Determine if all firearms have been properly reported. Assist agents on any recordkeeping issues as well as the filing of the theft/loss report.
IOI redacted recommends a Warning Conference, Warning Letter, issuance of a Report of Violations and no Recall inspection due to the following : •27 CFR 478.21(a) Forms Prescribed The licensee accepted and/or failed to accurately complete the Firearms Transaction Records (ATF Forms 4473 ). On redacted Transaction Record the licensee failed to record the transferor’s/seller’s name (Item #33). On redacted Transaction Record the licensee failed to record the transferor’s/seller's title (Item #35). •27 CFR 478.124(c)(1) Firearms Transaction Record The licensee accepted the Firearms Transaction Records (ATF Forms 4473) with blank or incomplete responses by the transferee. On redacted occasions the licensee accepted the Transaction Record with incomplete responses to transferee’s first or middle name (Item #1). On redacted occasions the licensee accepted the Transaction incorrectly abbreviated the city, incorrect abbreviated county, with “Yak", 'U.S.' or ‘USA’ or a blank response to the county or “WN” to state (Item #2). On redacted occasions the licensee accepted the Transaction Records which contained an incorrect response to the transferee’s state of birth (Item #3). On redacted occasions the licensee accepted Transaction Record with a blank or incorrect response to the Certification Signature (Item #16). On redacted occasions the licensee accepted Transaction Record with a blank or incorrect response to the Certification Date (Item #17). On redacted occasion the licensee accepted the Transaction Record with a "YES" answer to a prohibiting question but was found not to be a prohibited person. •27 CFR 478.124(c)(3)(i) Firearms Transaction Record The licensee failed to accurately record the transferee's identification on the Firearms Transaction Records (ATF Forms 4473). On redacted occasions the licensee failed to correctly record the Identification: Issuing authority and type, Number on Identification or Expiration Date of identification (Item # 20a). •27 CFR 478.124(c)(3)(iii) Firearms Transaction Record The licensee failed to obtain the required documentation showing an exception to the nonimmigrant visa prohibition on the Firearms Transaction Records (ATF Forms 4473). On redacted occasions the licensee failed to record any information in (Item #20c) when the transferee indicated that they are a nonimmigrant alien on (Item #11l) and also indicated that they were able to purchase a firearms on (Item #12). •27 CFR 478.124(c)(3)(iv) Firearms Transaction Record The licensee failed to record complete and accurate NICS information in Items #21d on the Firearms Transaction Records (ATF Forms 4473). On redacted occasion the licensee failed to record the date of the follow-up response from NICS after initially receiving a delayed response (item #21d). •27 CFR 478.124(c)(5) Firearms Transaction Record The licensee failed to record both the transferor’s/seller’s signature (item #34) and the date the firearm was transferred (item #36) on the Firearms Transaction Records (ATF Forms 4473). On redacted occasions the licensee failed to sign the Firearms Transaction Record (Item #34). On redacted occasions the licensee failed to record the date the firearm was transferred (Item # 36). •27 CFR 478.126(a) Forms Prescribed The licensee failed to report the multiple sales or other disposition of pistols and revolvers on the Firearms Transaction Records (ATF Form 4473). On redacted occasions involving redacted handguns the licensee failed to submit a multiple sales or other disposition of pistols and revolvers (ATF Form 3310.4) report when two or more handguns were sold to an individual within five consecutive business days.
An inspection was conducted to determine if the licensee is operating in compliance with Federal Firearms Laws and regulations. The inspection was conducted due to a theft at the licensed premises. The inspection disclosed redacted violations for failing to obtain properly completed ATF F 4473 and failing to submit Report of Multiple Sales forms. There were no firearms reported as missing as a result of the of the inspection. A Report of Violations was issued to the licensee. It is recommended that a Warning Letter be issued with a recall inspection .
