CONDUCT FIREARMS DISPOSITION EMPHASIS INSPECTION FOR THIS TYPE 01 LICENSEE. REFER TO IO MANUAL, CHAPTER C, AND THE ANNUAL CLEVELAND GROUP III DOMAIN ASSESSMENT. THIS INSPECTION SHOULD BE COMPLETED DURING FY17 AS REQUIRED BY THE DOMAIN ASSESSMENT.
Violations, Warning Letter Only, and Recall Inspection
On June 27,2017, A/S redacted reviewed and concurred with Investigator Snow's recommendation of a Warning Letter ( WL ) and Recall . This was the licensee's first compliance inspection. The licensee was cited for nine violations. Seven of the violations were ATF Forms 4473 related, one was for multiple sales , and one was for A&D records. Violations #7 and #8 merit Administrative Action consideration of a WL due to the percentage of each violation as follows: Violation #7 had redacted multiple sales that were not completed and redacted that were not submitted timely. All multiple sales forms were completed as a result and verified as received in E-Trace; Violation #8 involved redacted incorrect/incomplete acquisition entries (15.6%) and redacted incorrect/incomplete disposition entries (5.1%). This was mainly due to a computer problem identified by Investigators and ultimately the licensee decided to start completing bound book hard copies of his A&D records rather than computer. There were no missing firearms. The licensee was receptive to the education provided by Investigators redacted and corrected all violations that could be corrected almost immediately. The licensee has increased his internal controls to do a better job of reviewing the proper completion of the ATF Forms 4473 and the transition to paper A&D records should alleviate the magnitude of future A&D related problems. Future compliance with the GCA is anticipated and the Recall DEI will confirm if the licensee was able to institute all of the recommendations to his internal controls as offered by Investigators redacted.
