Conduct Firearms Compliance Investigation
An alternate recommendation is being offered in lieu of Warning Conference with Warning Letter and Recall for the following reasons. During this inspection the licensee was cited for only one violation [27 CFR 478.124(c)(3)(i)] for failing to identify the transferee/buyer as required in Section B, Item 20a redacted forms reviewed. The licensee is a low volume firearms dealer and the violation places the licensee at a 100% error rate. In addition, the licensee stated he uses the South Carolina Concealed Weapons Permit as the identification document, but was not aware he was required to also document the identification in Section B, Item 20a. The missing information was recorded by the licensee in Section B, Item 23 (Exemption to NICS ). Furthermore, this is the licensee’s first compliance inspection with a violation. In 2013, the compliance inspection resulted in “No Violations, No Further Action, No Referrals”.
