The following violation warrants a Warning Conference per Exhibit 1 of ATF Order 5370.1B, dated February 8, 2013: failure to have the transferees accurately complete the ATF Forms 4473 in Section A when legally required redacted instances and the licensee has previously been the subject of a warning letter and current inspection warrants a warning letter for repeated similar violation. A warning letter in lieu of a warning conference is recommended based on the following The current inspection is the licensee's second compliance inspection since receiving his Federal Firearms License December 1,2008 The failure to obtain complete and accurate information redacted ATF Forms 4473 was a result of an oversight on the licensee’s part and he did not intentionally overlook the required information the ATF Forms 4473. The current inspection is a reduction in the number of times the licensee violated 27 CFR 478.124(c)(1) from redacted instances to redacted instances, which is less than 1% of the ATF Forms 4473 that were reviewed during this review period. Only the violation of 27 CFR 478.124(c)(1) cited during this inspection rose to the level of a Warning Letter. All other violations cited did not rise to any level of administrative action . The licensee stated his intention to start a system to catch errors on the ATF Forms 4473 prior to completing any transaction(s).

DIO concurs with a recommendation of a WL in Lieu of a WC based on the repeat violation of 27 CFR 478.125(e), involving redacted missing firearms and warranting a WL and WC due to repeat in nature and the same number of occurences; and violation of 27 CFR 478.39a involving the licensee’s failure to report stolen firearms redacted o ATF when reported to the local authorities on 5/13/2016 and discovered by ATFs field investigation on 7/13/2016.
