Revocation is warranted based on the transfer of a receiver to an individual under the age of 21. IOI redacted recommends Violations, DIO (or Delegate) Held Warning Conference as an alternate recommendation to revocation. This was the first receiver to be transferred by the licensee. The licensee ordered the receiver as well as a trigger assembly and other parts for the customer. Because the licensee knew the customer was making a rifle, the customer being underage for a receiver did not occur to him. It is does not appear this violation was willful . The licensee is now aware receivers can only be transferred to individuals age 21 and older, no matter the circumstances. The licensee is a low volume firearms dealer. The licensee had 53 ATF Forms 4473 for the inspection period, redacted of which had errors resulting in three violations. If not for the transfer of the receiver, the inspection would have resulted in Violations, ROV Only. This was the licensee’s third compliance inspection. There were no repeat violations. The licensee had no traces and no missing firearms Previously, the transfer of a receiver to a person under the age of 21 on fewer than redacted occasions warranted only a Warning Letter. The Federal Licensing System License Registration Report is correct and there are no changes needed.
The inspection disclosed three violations, one warranting revocation. Specifically, a violation of 27 CFR 478.99(b) for the transfer of a receiver to an individual less than 21 years of age. However, when taking into consideration the licensee's compliance history and number of violations, overall, an alternate recommendation of Violations DIO (or Delegate) held WC ILO Revocation is proposed. This is the licensee's third compliance inspection since license issuance.
During this inspection, there were three violations cited (27 CFR 478.99(b), 27 CFR 478.124(c)(1) & 27 CFR 478.126a). redacted instance/form for each violation. Violation 27 CFR 478.99(b) warrants a recommendation of revocation. There were no missing firearms, no untimely acquisitions or dispositions, no transfers to prohibited persons, and no traces to this business within the last 12 months; therefore, I propose an alternate recommendation of warning letter.
