Please conduct a Type 07 FFL DE Compliance Inspection. As part of this inspection, please conduct the following activities: -- Obtain a business profile to ensure proper licensure -- Explore ownership and control to include Deconfliction Queries -- Complete a full physical inventory of the firearms on hand in conjunction with an A&D Records review. If any missing/unaccounted for firearms are identified, notify CE and assist the licensee with properly reporting the missing firearm(s) -- Comprehensive review of ATF Form 4473s for the inspection period with a focus on suspicious purchasers. Refer any suspicious purchasers to the proper CE Group. -- If acrtively manufacturing, verify Records of Manufacture and ensure proper markings are placed on the manufactured firearms -- Confirm that the licensee is accurately and timely filing AFMER Forms -- Ensure that all multiple handgun sales conducted during the inspection period are reported properly and timely on ATF Form 3310.4s -- Examine licensee's trace history and document in the Narrative & NSPECT --Issue a ROV for any violations cited (if applicable) -- Complete a Federal Firearms Regulations Review with a RP . As part of this review, determine if the licensee is registered with the DDTC. If not registered, issue the appropriate Referral of Information to the DDTC. Dates of Inspection: 07/19/2016-08/17/2016 Scope of Inspection: Type 07 FFL DE Compliance (Manuf) Time Frame of Inspection: 07/19/2015-07/19/2016 Recommendation: Violations; ROV ; WL Only; No Recall SIOI redacted A/S Comments: From 07/19/2016-08/17/2016, SIOl redacted completed a Type 07 FFL Compliance Inspection at Czar Firearms, Inc. RPs Lisa Kondrick and Kirk Voeckel were present for the inspection. During this inspection, SIOI redacted inventoried a total of 97 firearms, reviewed 885 ATF Form 4473s , and examined 735 Acquisition and 730 Disposition Entries. As a result of her inspection, SIOI redacted cited the following five (5) violations: 1.) 27 CFR 478.21(a) - Forms Prescribed (CITED) Failure to obtain a properly completed ATF F4473. (885) forms were examined. Errors were found in redacted instances on redacted forms. In redacted instances, the transferee answered "No" to Item 11(a), Are you the actual buyer of this firearm? The licensee proceeded with the sale. In redacted instances, the transferees' failed to provide a response to Item (a), Are you the actual buyer of this firearm? The licensee proceeded with the sale. In redacted instance, the licensee leredacted. In redacted instance, the licensee left Item 33, (Transferor's/Seller's Name) blank. In redacted instance, the licensee left Item 35, (Transferor's/Seller's title) blank. 2.) 27 CFR 478.124(c)(1)-Firearms Transaction Record (CITED) Failure to obtain a properly completed ATF F 4473. (885) forms were examined. Errors were found in redacted instances on redacted forms. In redacted instance, the transferee left Item 13, (State of residence) blank. In redacted) instance, the transferee left Item 14, (What is your Country of Citizenship) blank. In redacted instance, Item 17, (Certification date) was incorrect. 3.) 27 CFR 478.124(c)(3)(i) - Firearms Transaction Record (CITED) Failure to obtain a properly completed ATF F4473. (885) forms were examined. After the transferee has executed the ATF F4473, the licensee shall verify the identity of the transferee by examining the identification document. The licensee failed to receive a valid identification in redacted instance on redacted form. In redacted instance, Item 20a was left blank. 4.) 27 CFR 478.124(c)(5) - Firearms Transaction Record (CITED) Failure to obtain a properly completed ATF F4473. (885) forms were examined. Errors were found in redacted instances on redacted form. In redacted instance, the licensee left Item 34, Transferor's/Seller's Signature blank. In redacted instance, the licensee failed to record the correct date in Item 36. 5.) 27 CFR 478.99c - Sales or deliveries to prohibited categories of persons (CITED) Failure to obtain properly completed ATF Forms 4473. (885) forms were examined. Errors were found in redacted instances on redacted forms. In redacted instances, the licensee transferred a firearm after the transferee answered "YES" to prohibiting question, Item 11.i, Section A of the ATF F4473. The transferee answered "YES" to Have you been convicted in any court of a misdemeanor crime of domestic violence? The licensee proceeded with the sale. Based upon these results, SIOI redacted recommended, "Violations; ROV; WL Only; NO Recall ." A/S Recommendation: A/S redacted agrees with SIOI redacted's recommendation in part. In accordance with SIOI redacted's recommendation and per Adverse Action Policy, Violations #3 and #5 merit a Warning Letter. The Warning Letter will be issued via Certified Mail on 09/02/2016. However, based upon the number of violations and number of instances of each violation, A/S redacted feels as though a Recall Inspection is warranted. Specifically, the Recall Inspection is needed to ensure the licensee's ATF Form 4473 recordkeeping has improved.
