The FFL has been licensed since 2012. This is the first inspection and the licensee is a low volume dealer. The inspection yielded a sale to a non-licensee where an ATF F 4473 was not completed. Additionally, the licensee failed to conducted a NICS check. In the redacted instance, the licensee closely knew the buyer, who had the firearm on layaway. The licensee instructed the buyer to return to the store, complete the ATF F 4473 and a NICS check was conducted, where the buyer recieved a proceed. A recommendation of warning conference was recommended by the Lead IOI and Area Supervisor. After discussion with the Area Supervisor, DIO recommends a warning letter with no recall inspection in lieu of a warning conference.
