The following violation warrants a Warning Conference per Exhibit 1 of ATF Order 5370.1B, dated February 8, 2013: failure to file multiple sales reports when legally required on fewer than five instances and the licensee has previously been the subject of a warning letter or warning conference and current inspection warrants a warning letter for repeated similar violation(s). The licensee failed to file complete multiple sales reports in redacted instances. A warning letter in lieu of a warning conference is recommended based on the following: • The failure to file multiple sales reports violation was a result of the licensee filing a complete multiple sales report when the transferee purchased a single handgun and then returned to the premises and purchased two handguns at the same time within the five business day time period. The licensee properly reported the handguns purchased at the same time on a multiple sale report, but did not report the single handgun as a part of the multiple sale. • In the previous inspection, the licensee failed to report redacted multiple sales. The failure to add redacted firearm to each multiple sale is a reduction in the number of times the licensee violated 27 CFR 478.126a. • Only the violation of 27 CFR 478.126a cited during this inspection rose to the level of a Warning Conference. All other violations cited either rose to the level of a Warning Letter or did not rise to any level of administrative action . • The licensee stated his intention to start a system to catch multiple sales when the purchase of multiple handguns occurs on different days instead of at the same time.

DIO concurs with recommendation of a WL ILO WC and no Recall Inspection . A WL will be issued for the violation of 27 CFR 478.99(c)(1) and 27 CFR 478.126a.
