Conduct DE compliance inspection.
A Firearms compliance investigation was conducted for the licensee listed above. A total of six violations were cited for failure to properly obtain and/or complete Forms 4473 ; failure to properly verify and/or record identification document of transferee; failure to record background check information; failure to record the acquisition redacted instances resulting in 35%) and disposition redacted instances representing 27%) of firearms; failure to properly maintain filed Forms 4473s. A Warning Conference is warranted based on the untimely recording of acquisition and dispositions. However, Area Supervisor is recommending an alternate recommendation of ROV and Warning Letter Only, and No Recall based on the following: this is licensees first compliance inspection; no firearms were missing after reconciliation; most discrepancies were correctable (including the ones that warrant a Warning Conference); there are internal controls in place that appear adequate; and there were no unsuccessful traces. In addition, main Responsible Person had some personal matters that deviated his attention from the business, but he is now back full time. Finally, IOI redacted thoroughly reviewed regulatory requirements with licensee; and Responsible Person stated that he now understands them and will ensure compliance.
DIO recommends Warning Letter and Recall inspection , based on the facts that the licensee failed to account for redacted firearms properly within their A&D records. The licensee failed to enter redacted firearm acquisitions and redacted dispositions into the A&D Book. Due to the lack of internal controls and the licensees acknowledgement that in calendar year 2015, that personal matters/issues led them to not focusing enough attention on their GCA requirements.
