On November 5, 2015, Investigator initiated an unannounced firearms compliance investigation at Dunn’s Sports, which is situated at the above referenced location As a result of this investigation two (2) violations were cited, which are noted below: 1. 27 CFR 478.125(e) Failure to properly maintain the A&D Record (physical inventory open dispositions jn redacted instances; and 2. 27 CFR 478.124(c)(4) Failure to record "Type" information (Section D, item 29) on redacted Form 4473 and failure to record "Caliber or Gauge" information (Section D, item 30) [redactd] Form 4473.
Updated - DIO concurrence recvd fro WL ILO WC - WL mailed on 2/8/16 to FFL Pending DIO concurrence: A Warning Letter in lieu of a Warning Conference (WL ILO WC) with a recall inspection is recommended ( ROV issued). - A compliance inspection was initiated on 11/5/2015 and completed on 11/16/2015 at the licensed premises in Thomasville, AL. The inspection disclosed two violations: 27 CFR 478.124(c)(4); and 27 CFR 478.125(e) REPEAT Violation 2009 inspection redacted instances Munreconciled missing firearms. During the 2009 inspection redacted firearm was missing with redacted additional A&D errors. The FFL stated he ha not conducted an inventory in over a year butwill start conducting inventory reviews every six months to ensure the violation will not be repeated. He will also start double checking the forms to ensure they are completed properly. The IOI is confident that the FFL will not repeat the violations if the new procedures are implemented as intended.
The DIO has reviewed the report and supporting documentation for this case and he concurs with the alternate recommendation of warning letter in lieu of warning conference. One of the two violations that were cited rises to the leval of warning conference as this licensee has attended a warning conference for one of the violatios in 2009. However, the DIO concurs with the alternate recommendation because this licensee had no violations in a 2011 inspection, had a low number of instances within the two violations, and the IOI believes that the internal controls that are now in place will ensure future compliance.
