An alternate recommendation of WL and no recall inspection is being recommended by lOI redacted based on the unique circumstances involving an unreported multiple sale form. Store Manager, stated he does not Know if the ATF National Tracing Center_ (NTC) did not receive it because it was not faxed properly or oecause tne fax did not go through. Based on the timely reports of| other multiple sales, IOI redacted recommends WL only.
Based on the violation issued and inspection history, the alternate recommendation of a warning letter and no recall in lieu of a warning conference is being submitted. The licensee was cited for failure to timely submit the multiple handgun sale form. The form was completed, however, not entered into the trace history for an unknown reason. In addition, the licensee has improved from their previous compliance inspections, where they were cited for three violations. Therefore, a warning letter only is being recommended.
During this inspection, a violation for 27 CFR 478.126a was cited redacted instance). This violation warrants a recommendation of warning letter; however, because the licensee received a warning letter previously for the same violation, a recommendation of warning conference is warranted. There were no missing firearms, no transfers to prohibited persons, no firearms not timely entered or logged out of the A&D record. The licensee was cited three violations during their last inspection. This inspection only had one violation with instance; therefore, I recommend an alternate recommendation of warning letter with no recall inspection .
