The licensee was cited for a total of 4 violations as a result of this inspection. According to ATF O 5370.1B, the following 3 violations warrant Administrative Action : #1. 27 CFR 478.124(a)-Failure to execute ATF Form 4473 in redacted instance. ATF O 5370.1B calls for a Warning Conference. #2. 27 CFR 478.125(e)-Failure to create and maintain a complete and accurate record of Acquisition & Disposition in redacted instance: redacted firearm missing after inventory reconciliation. ATF O 5370.1B calls for a Warning Letter. #3. 27 CFR 478.102(c)-Failure to initiate a new NICS background check after 30 days in redacted instances. ATF O 5370.1 B calls for a Warning Letter. This FFL was originally issued in 1988 and prior compliance inspections have been conducted in 2003 and 2010. Only one of the violations cited in this inspection was a repeat violation (#2) from the 2003 inspection and occurred in only redacted instance. In regards to Violation #1, the licensee stated that he misunderstood the requirements and thought he could add a gun to a previously completed form if the second purchase occurred within 7 days. In regards to Violation #3, the licensee explained that these violations occurred as the result of a change in his procedure to handling layaway purchases of firearms. Background checks were conducted by Investigator redacted during the inspection on the purchasers involved in Violations #1 & 3 and no prohibiting information was discovered. Approximately 55 firearms were transferred during the inspection period, and each of the violations cited during the inspection occurred in redacted instances or less. Based on considerations identified above, Investigator redacted alternatively recommends that a Warning Letter is issued with no recall inspection instead of a Warning Conference with recall as outlined in ATF O 5370.1B. I reviewed the compliance inspection report and the cited violations by the IOI . There was only one violation cited in the current inspection that was a repeat violation from the previous inspection in 2003. The IOI further instructed the FFL on the other cited violations which the FFL was thankful and receptive to receive. Based on the findings, I concur with the recommendation of the IOI for Violations, Warning Letter Only nad No Recall Inspection. The inspection report was forwarded to DIO Diana Mitchell on 3/25/16 for review.
DIO concurs with recommendation of a WL and No Recall Inspection in LIEU of a WC for the violation of 27 CFR 478.124(a), repeat violation of 27 478.125(e) and 27 CFR 478.102(c). Issue WL by 4/5/2016.
