A Report of Violations was issued and a Warning Letter (no recall ) is recommended in lieu of a Warning Conference due to the following mitigating factors: (1) The licensee was cited for failing to record the disposition information for redacted firearm in the Acquisition and Disposition ( A & D ) Record. The firearm could not be accounted for, and was reported as missing inventory on ATF Form 3310.11, Report of Theft/Loss. This was the only violation disclosed during the inspection. The firearm represents less than 1% of the redacted firearms received during the last 12 months. (2) Licensee has shown improvement in maintaining the A & D Record over the last 4 inspections. A & D Record violations have improved from redacted instances (2012 inspection), to redacted instances (2014 inspection) redacted instances (2015 inspection), and redacted instance during the current inspection. (3) Licensee has shown improvement in ensuring proper completion of ATF Forms 4473 over the last 3 inspections. Violations regarding the ATF Forms 4473 have been reduced from 5 violations (2014 inspection), to 1 violation (2015 inspection), and no violations during the current inspection.

Reviewed the inspection report and the one violation disclosed as a result of the inspection. I concur with the recommendation of the IOI for a Viols WL ONLY and No Recall Inspection in lieu of a Warning Conference This FFL has continued to improve his firearms business and reduce the number of violations from each of the previous inspections.
DIO concurs with recommendation of a WL ILO WC and No Recall Inspection . Although the violation of 27 CFR 478.125(e) warrants warning conference due to repeat violation, the instance of this violation reduced significantly, involving only redacted firearm being reported as missing.
