CONDUCT DE COMPLIANCE INSPECTION UTILIZING GUIDELINES SET FORTH IN IO MANUAL. LICENSEE IS A DEMAND LETTER RECIPIENT, PLEASE ENSURE THE APPROPRIATE PAPERWORK HAS BEEN SUBMITTED AS REQUIRED AND DOCUMENT SUCH IN THE REPORT.
As a result of a DE Compliance Inspection a Report of Violations was issued for violation of 27 CFR 478.125(e), repetitive from inspections conducted in 1992, 1993, 2000, 2004, and 2012, and 27 CFR 478.126(a) which was repetitive from the 2012 inspection. The licensee has been the subject of a DIO led WC within the previous 5 years, 1/9/13, and the current inspection reveals repeated similar violations but there has been significant improvement since the 2012 inspection which warranted a DIO led WC . Specifically, in 2012 the licensee was cited for 11 violations and only 2 in the current inspection, though they are repetitive from the 2012 inspection. The recall inspection in 2014 resulted in no violations also. In 2012 the licensee failed to timely record redacted entries in the A & D record with redacted firearms being reported missing to NTC. The current inspection resulted in redacted entries in the A & D record not timely recorded with redacted firearms being reported missing to NTC showing significant improvement by eliminating half of the repetitive errors. The licensee failed to prepare and submit the redacted for the 2nd, 3rd, and 4th quarters of 2011 and 1st quarter of 2012 and the current inspection revealed that the licensee failed to timely submit all four quarterly reports for the time period January 1, 2016 thru January 1, 2017. The current inspection also resulted in no errors from the review of [missing] ATF Forms 4473s compared to 122 Forms or a 9.7% error rate of forms reviewed in the 2012 inspection. The licensee was associated wredacted trace requests during the review period none of which were unsuccessful. One referral of information was generated for a possible straw sale /suspicious purchaser forwarded to CGIC for consideration. The licensee has had similar referrals generated from past inspections and has been very cooperative with the ATF Philadelphia Field Office and the Philadelphia PD Firearms Trafficking Task Force. In view of the above improvement from the last DIO led WC it is recommended that another DIO led WC be held with a Recall inspection to be staged in Lieu of Revocation.
The compliance investigation disclosed two (2) repeat violations (i.e redacted unrecorded dispositioredactedissing gun redacted linquent redacted reports) which due to the compliance history of this licensee, by policy, subjects the license to revocation if willful . However, as there is evidence of improvement since the last administrative action in 2012 (e.g., previously cited for 11 violations, contrasting with only two this time; there were no Form 4473 deficiencies, and the A&D record deficiencies are to a lesser extent than in 2012), and given the business volume relative to the violations, with no unresolved traces, or unreported multiple sales , nor significant threat to the public safety, as well as in consideration of Division Counsel's opinion, concur with the A/S 's analysis and recommendation for a DIO WC in lieu of revocation, as deemed sufficient AA to address the violations.
