CONDUCT FULL COMPLIANCE INSPECTION.
From August 26, 2016 to January 23, 2017, IOIs from the Albuquerque II (10) Field Office have made numerous and repeated efforts to conduct a compliance inspection and to make face-to-face contact with Dustin Fite, owner of Crosshairs Gunshop. All attempts met with negative results. No compliance inspection was able to be conducted. It was also learned that Dustin Fite moved from the licensed premise address in approximately November 2016 but failed to notify ATF of that move. Recommend revocation of the FFL .
The licensee abandoned the licensed business premises and relocated without completing the required ATF Form 5300.38 - Application for an Amended Federal Firearms License. Between August 25, 2016 and January 23, 2017 approximately 13 attempts were made to either contact the FFL or schedule an inspection. On January 5, 2017, ATF confirmed through the Property manager that the licensee does not have access to the licensed premise and has not had access since mid-October 2016. A Cease and Desist Letter was sent certified return receipt to the licensee’s last known address. The letter was received and signed for by the licensee on January 6, 2017. The licensee has not contacted the ATF since receiving the Cease and Desist Letter. Therefore I concur with the Investigator and the Area Supervisor’s recommendation of Revocation.
