Per ATF O 5370.1 B I recommend revocation. The FFL participated in a transaction where the original customer who indicated he was the actual purchaser of the firearm on his F 4473 was deemed to be prohibited and denied by the DROS system. The dealer proceeded to facilitate the transfer of the firearms to the spouse of the individual, knowingly engaging in a straw purchase and falsifying the A&D record.
My decision is to pursue revocationof this license. In pertientn part, the licensee wilfully distributed a firearm to a prohibited violent felon through the prohibited violent felon's spouse.
