Violation #1: The transfer of a firearm, other than a shotgun or rifle (receiver), to an out-of-state resident; meets the criteria for a WARNING CONFERENCE according to Section 6.d(12) of the current Adverse Action Policy. In addition, Violations #2, 4, 6 and 7 meet the criteria for a WARNING LETTER under Sections 6.c(4), 6.c(6), 6.c(17) and 6.c(7) respectively. Basis for ALTERNATE RECOMMENDATION : The individual who transferred redacted began employment in November of 2015 and had no prior firearms experience. None of the current employees were with the licensee when they were last inspected in 1998. The licensee was receptive to suggestions for improving internal controls and was also cooperative and accommodating during the inspection. Based on these facts an alternate recommendation of a WARNING LETTER is submitted. In addition, REMOVE redacted AS A RP , at the request of the licensee (Exhibit #1)
ALTERNATE RECOMMENDATION : WARNING LETTER w/ RECALL The inspection meets the standard for Warning Conference under the Adverse Action Policy (2/8/2013). The licensee was cited for failing to prevent the transfer of redacted receiver to an out-of-State resident - WC at Sec. 6 d (12). Other violations meeting adverse action: Violation-2 - transfer in redacted instance of a firearm to a person who appeared prohibited at the time of transfer - WL at Sec. 6.c.(4); Violation-4 - failure to record any ID on forms (2%) WL at Sec. 6.c.(6); Violation-6- failure to initiate a new NICS check after 30 days - WL at Sect. 6.c.(17); and Violation-7 - failure to submit a Report of Multiple Handgun Sale in redacted instance involving redacted firearms. WL at Sec. 6.c.(7). JUSTIFICATION FOR ALTERNATE: The licensee had not been subject to a compliance inspection since 1998. The employee responsible for the improper transfer redacted had only been employed since November 2015, and none of the current employees were with the licensee at the last inspection. The licensee was receptive to the corrective actions and took immediate action to prevent future violations.
