CONDUCT DE RECALL COMPLIANCE INSPECTION UTILIZING GUIDELINES SET FORTH IN THE IOI MANUAL.
As a result of a DE Recall Compliance Inspection, A report of violations was issued for violation of 27 CFR 478.126a - REPEAT violation from 2005 and 2015. The licensee previously attended a Warning Conference for a similar violation in 2005 where the licensee failed to report the multiple sale of handguns on redacted occasions. In the 2015 recall inspection, the licensee failed to report the multiple sale or other disposition of pistols or revolvers, ATF F 3310.4, in redacted instances involving redacted firearms and was issued a WL alternate to holding a WC . This represented approximately 50 percent of the multiple sale of firearms or other dispositions required to be filed during that inspection period. During this current inspection the licensee failed to report the multiple sale of handguns on redacted occasion involving redacted handguns representing a 3.4% error rate. IA redacted ran the redacted serial numbers for the unreported Multiple Sale in OpenFox on 2/14/17 disclosing no hits. There were no violations disclosed concerning the accountability of inventory nor from the review of 3000 ATF Forms 4473s . There were redacted traces completed over the last year with approximately 3000 firearm dispositions during the same timeframe. In view of this, it is recommended that a Warning Letter be issued, and no Recall Inspection be staged due to the improved compliance alternate to holding a Warning Conference.
On this 2nd Recall compliance investigation, 1 repeat violation was found (i.e., unreported MS involving redacted HGs) and considering that there were redacted traces, evidence of traffiking or straw sales , nor transfers to prohibited individuals or apparent threat to the public safety, concur with the A/S 's alternate recommendation of a WL no Recall in lieu of a WC , as sufficient AA to address the violations.
