The following two violations rose to the level of a warning letter: 1.Failure to conduct and/provide proof of conducting a NICS Background Check and/or obtain a suitable exemption to the Background Check redacted occasions. 2.Failure to file a multiple handgun sales report redacted occasion. Per Exhibit 1 of ATF Order 5370.1B, dated February 8, 2013, a Warning Conference is warranted for repeated similar violations as the licensee has previously been the subject of a warning letter or warning conference, and the current inspection warrants a warning letter. A warning letter in lieu of a warning conference is recommended based on the following: •The two employee responsible for completing the ATF Forms 4473 where redacted unacceptable permits were accepted as an exemption to NICS and redacted expired permit was accepted no longer work for the business. A new office manager has been hired and is committed to follow newly established standard operating procedures that are being established to avoid future violations. •Even though the licensee was cited for eight violations, only two violations rose to the level of a warning letter. All other violations cited did not rise to any level of administrative action . •The licensee was fully cooperative and is willing to do whatever it takes to be in compliance with the regulations. •The licensee has requested that ATF provide a training session redacted

Concur with recommendation of warning letter ILO warning conference, as only two repeat violations out of eight violations, warrant an administrative action of a warning letter involving 27 CFR 478.102(a)(1) for acceptance of a nonqualifying permit as an exemption to NlCs redacted instances, and 27 CFR 478.126a for failure to complete/file a multiple handgun sales report redacted instance.
