ALTERNATE RECOMMENDATION The licensee transferred redacted receivers to an out-of-state (Florida) resident in violation of 27 CFR 478.99(a). This infraction rises to the level of Warning Conference within the purview of the Administrative Action Chart. The following facts and circumstances are given to justify an alternate recommendation of Viols WL ONLY and No Recall Inspection : 1. This is the licensee's first regulatory compliance inspection. 2. redacted 3. The licensee is a low volume residential dealer. 4. The licensee misunderstood the regulation in reference to the prohibition of transferring receivers to out-of-state residents.
ALTERNATE RECOMMENDATION The licensee had only six (6) ATF Forms 4473 on file for the inspection period. Out of the six (6) forms, redacted form contained three violations. The licensee transferred redacted receivers to an out-of-state (Florida) resident in violation of 27 CFR 478.99(a), the licensee failed to identify the Type of firearm being transferred in violation of 27 CFR 478.21(a), and the licensee failed to provide a certification signature and date in violation of 27 CFR 478 124(c)(1). The infraction of 27 CFR 478.99 rises to the level of Warning Conference within the purview of the Administrative Action Chart. The following facts and circumstances are given to justify an alternate recommendation of Viols WL ONLY and No Recall Inspection : 1. This is the licensee’s first regulatory compliance inspection 2. redacted 3. The licensee is a low volume residential dealer redacted firearms were acquired and redacted firearms were transferred during the inspection period. 3. The licensee misunderstood the regulation in reference to the prohibition of transferring receivers to out-of-state residents. 5. A subsequent background check of the transferor who received redacted receivers was conducted with no proh biting factors found on file. I concur with the Alternate Recommendation as stated by the lOI for a Warning Letter and No Recall Inspection.
The inspection revealed three violations of which two rose to the level of an administrative action for the following. 27 CFR 478.124(c)(1) warrants a WL for the licensee's failure to obtain complete and accurate information for any item(s) redacted ATF Form 4473 , where the buyer failed to sign and date the Form in Section A involving 16% of the forms reviewed. 27 CFR 478 99(a) warrants a WC for the failure to prevent the transfer of redacted receivers to an out-of-State resident, involving redacted ATF Form 4473. The issuance of a WL and No Recall Inspection is recommended based is compliance being the FFL ’s first investigation since the issuance of the license in May of 2015.
