Conduct full manufacturer of firearms inspection. Refer to IO Manual Chapter C - Firearms Inspections and FY 16 Domain Assessment. Ensure licensee has filed all AFMERs , if any are missing obtain them during inspection. Conduct 100% inventory and ATF Form 4473 review unless authorized in advanced by Area Supervisor and DIO .
ALTERNATE RECOMMENDATION : Licensee failed to create an acquisition and disposition record regarding firearms manufactured in violation of 27 CFR 478.123(a), 27 CFR 478.123(b) and 27 CFR 478.124(d). These violations would warrant a recommendation for a Warning Conference. Licensee recorded the acquisition of lower receivers that were manufactured into rifles in the firearms dealer A&D record. Licensee correctly recorded the type of manufactured firearm as rifle when transferred on ATF Form 4473 to redacted. Licensee failed to properly record firearms as manufactured but traceability of said firearms was not compromised. An alternate recommendation for violations, warning letter with a recall inspection is proposed. Licensee was cited for five (5) violations [478.124(c)(1); 478.123(a); 27 CFR 478.123(b); 478.123(d); 18 U.S.C. 23(g)(5)(A)], A warning letter is warranted based on Licensee’s transfer of a firearm to a person who appeared prohibited at time of transfer but was not actually prohibited redacted and the inability to produce documentation for redacted firearms missing from inventory redacted A recall inspection is warranted to ensure Licensee correctly records all future entries to the acquisition and disposition record, both for dealing in and manufacturing of firearms. Licensee failed on redacted form to obtain a complete ATF Form 4473 from the purchaser before transferring a firearm showing their name, sex, residence address, date and place of birth, height, weight, state of residence, and certification from the transferee that they were not prohibited from receiving or possessing a firearm in violation of 27 CFR 478.124(c)(1) redacted] While the citation is repeated from the previous inspection, the nature of the violation differs. Licensee was cited in the previous inspection (UI# 773015-2012-0575 BIB) for failure to obtain certification in Block 17 from the transferee redacted forms. Licensee was cited in the current inspection for failure to prevent transfer of a firearm to a person who appeared prohibited at time of transfer but was not actually prohibited. The nature of the violation does not meet the criteria for a repeat violation and therefore does not warrant a warning conference.
