A manufacturer of firearms compliance inspection was conducted December 5, 2013 through December 12, 2013. The licensee was cited for one violation. Violation merits a Warning Conference with Warning Letter and recall inspection . Conduct a Disposition Emphasis (DE) recall compliance inspection. 100% inventory verification and 12 months ATF Forms 4473 review is required.
This recall compliance inspection was conducted in response to a compliance inspection completed in 2013 that resulted in a warning conference. The licensee was cited for repeat violations of 27 CFR 478.123(a) and .123(b) for failing to enter the required acquisition entries on redacted occasions and failing to enter the required disposition entries on redacted occasions which equates to 550% of the licensee's total dispositions for the inspection period. Per ATF O 5370.1B, revocation is warranted when the licensee had previously been subject of a warning conference within the last 5 years and the current inspection warrants a warning conference for repeated similar violations. However, this FFL is an extremely low volume manufacturer that has had no traces during the inspection period. Additionally, this FFL only transfers firearms to other FFLs and makes no sales to nonlicensees. Furthermore, the current inspection and the licensee's inspection in 2013 resulted in a single violation for failing to enter all required information in the A&D record - no other recordkeeping or conduct of business violations were disclosed. As such a DIO led warning conference in lieu of revocation is the most appropriate AA .
Conducting a DIO held warning conference in lieu of revocation is recommended as an alternate recommendation . The licensee was the subject of a warning conference in 2014 for the failure to properly maintain the acquisition and disposition record in redacted instances. This current inspection revealed repeat violations. The licensee failed to record redacted dispositions and redacted acquisitions were not recorded timely. A total of redacted firearms were missing after reconciliation. The licensee acquired redacted firearms and disposed of[ redacted] firearms for the inspection period. The violations cited during this inspection rise to the warning conference level. Given, the licensee received a warning conference previously for a repeated violation, based on the licensee's history, revocation is recommended. However, as an alternate recommendation, a warning conference with the DIO will be sufficient to ensure the responsible person fully understands the requirement to ensure the acquisition and disposition record is properly completed especially for traceability purposes. Further, the number of instances has decreased somewhat since the last inspection. The licensee has shown some improvement. A warning conference with the DIO will ensure the licensee has another opportunity to comply prior to pursuing revocation. On October 20, 2015, notification was received from ATF HQ (FMSISB) an alternate recommendation to hold a warning conference in lieu of revocation was approved. The Area Office may proceed with scheduling the warning conference with the licensee to include the DIO's attendance.
