Licensee was cited for violation of 27 CFR 478.124 (c)(3)(i) in redacted instances. This violation met the criteria for a Warning Conference per the Federal Firearms Administrative Action Policy and Procedures, however an alternative recommendation of Report of Violations ( ROV ) and a Warning Letter is recommended due to the fact that no past negative compliance history exists. IOI redacted reviewed the Renewal Application for a Federal Firearms License with the licensee. Mr. Munafo amended the following: Item 7a and7b to cross off the number five and replace it with the number six Checked the Letter of Authorization (LOA) box Recommend renewal of application for Frank A. Munafo dba F&M Mill & Bldg. Supply Co.
Proprietor was issued a violation of 27 CFR 478.124 (c)(3)(i) in redacted instances, which is 100% error ratio. Per ATF O 5370.1 B - Federal Firearms Administrative Action Policy and Procedures, this violation merits a WC . A/S redacted agrees with the alternate recommendation of WL only since licensee has no previous violations and he immediately contacted purchasers to rectify the errors. Notifying DIO Curtis on 10-18-16 for his concurrence. DIO Curtis agreed with above on 10-21-16.WL sent out 10-26-16. Renew Type 01 FFL .
DIO concurs with alternate recommendation of WL & No Recall in lieu of WC . Although the redacted erroneous 4473 's warrant WC because they encompassed all 4473’s on file for the review period, the FFL had no prior history of violations, and is proactively working to correct the errors. Accordingly, WL will sufficiently address the errors.
