Senior Industry Operations Investigator (SIOI) redacted and Industry Operations Investigators (IOIs) redacted a compliance inspection at Nardis Gun Club from March 6 -10, 2017. There was no advance notification provided. It shall be noted this was an OJT assignment for redacted. In addition, San Antonio II Area Supervisor was onsite on March 8, 2017 to assist in the review of the ATF Forms 4473 . Mr. Marc Rodriguez, Store Manager, Mr. Jason Baum, Operations Manager and Jay Thurmon, Manager/General Manager were interviewed during the inspection. The closing conference was held on March 22, 2017, and four violations were cited. An alternate recommendation from Warning Conference to a Warning Letter is being recommended. This is the Nardis Gun Club’s second compliance inspection since receiving the Federal Firearms License in July 2011. Nardis Gun Club was cited for four violations and only one violation (27 CFR 478.99(a)) merits a Warning Conference. There are no repeat violations disclosed during the inspection. The FLS database needs to be updated to reflect a new mailing address of 4818 1-10 East, Suite 108, San Antonio, TX 78219. Mr. Jay Thurmon provided a written statement requesting the mailing address be amended (Exhibit 6). The fax number should be updated to 210-661-8301. The following email addresses should be added for Jason Baum (jason@nardisgunclub.com) and Jay Thurmon (doug@nardisgunclub.com). The residence address for James Thurmon should be updated to redacted.
This is an alternate recommendation of WL and no recall . An alternate recommendation is being made due to the licensee being a high volume dealer and one form being cited out of nearly 2,000 reviewed. The licensee conducts numerous transactions with military personnel and mistakenly accepted TDY orders. The licensee also had only five firearms traced, none of which were traced to Mexico. Additionally, the licensee did not have any missing firearms after reconciliation out of a large inventory of firearms.
During this inspection, there were four violations cited, one of which warrants a recommendation of warning conference. The licensee transferred a handgun to an Out of State resident in redacted instance. The transferee is a member of the Armed Forces, but was on temporary orders to the Brooke Army Medical Center for medical treatment (179 days). An RP stated the employee and manager handling the transaction misunderstood the military orders. Additional instruction was provided to the two RPs attending the Closing Conference. There were no missing firearms, no unrecorded acquisitions or dispositions, no unreported multiple sales , and no transfers to prohibited persons. Therefore, an alternative recommendation of a warning letter and no recall inspection will be rendered.
