The following violation warrants a Warning Conference per Exhibit 1 of ATF Order 5370.1B, dated February 8, 2013: redacted firearms after inventory reconciliation and the licensee was previously subject to a warning letter or warning conference for repeated similar violations. The licensee reported four firearms missing as a result of this inspection. A warning letter in lieu of a warning conference is recommended based on the following: - The 2014 inspection resulted redacted firearms reported missing. The current inspection only resulted redacted firearms being reported missing, indicating that internal controls have been strengthened. - Only one other violation was cited during the current inspection, for a total of two violations. The other violation cited did not rise to any level of administrative action . The 2014 inspection had a total of eight violations. The reduction in the number of violations also indicates that the internal controls have been strengthened. - Mr. Brannon Owens has started working for the business full time since the 2014 inspection. He stated that he has started recording the acquisition of firearms in the A&D Record immediately. He also stated that he records acquisition dates on the firearms as they are entered into the A&D Record. This new policy should aid the licensee in eliminating violations concerning acquisitions of firearms in the A&D Record. Mr. Owens also stated that he places a check mark on top of the ATF Form 4473 when he reviews it and then he places another check mark on the form when the disposition is recorded in the A&D Record. This policy should eliminate any issues with properly completing the ATF Forms 4473 and greatly reduce violations concerning the recording of firearms dispositions. - Mr. Owens made several statements concerning his willingness to make sure that the violations did not occur again. He stated that any number of violations was unacceptable and that he is trying very hard to improve his performance.

The reduction in the number of violations also indicates that the internal controls have been strengthened. - Another employee now works at the business and new policies have been implemented that should aid the licensee in eliminating violations concerning acquisitions of firearms in the A&D Record, properly completing the ATF Forms 4473 and greatly reduce violations concerning the recording of firearms dispositions. - Licensee made several statements concerning a willingness to make sure that the violations do not occur again. Licensee also stated that any number of violations was unacceptable and hard work is in place to improve performance.
The administrative action policy violation chart warrants a recommendation of a warning conference for the repeat violation of 27 CFR 478.125(e) redacted firearms reported as missing. Based on the significant reduction in the number of instances from the previous inspection in 2014 from redacted instances to redacted instances, and there only being two violations discovered from the current investigation, the recommendation for a warning letter and no recall investigation is supported.
