Alternate - Violations Warning Letter Only and No Recall Inspection A Warning Conference could be warranted based on the following violations: • Failure to timely/correctly record disposition : redacted instances, 25.8% • Missing redacted firearms after inventory reconciliation (i.e. no records of disposition). Basis for alternate recommendation: Only redacted of disposition errors occurred within the past twenty (20) years. Only redacted of the missing firearms was obtained during the past twenty (20) years (1996); the remainder were obtained between 1981 and 1988. The last documented inspection in N-Spect was in 2011, in which no violations were cited. The licensee stated he did not present the old A&D records during the previous inspection since the entries were more than twenty (20) years old. IOI redacted believes an alternate recommendation is justified because the missing firearms would have been discovered during the previous inspection if the licensee had presented the old A&D records at that time. Also, the licensee expressed a strong desire to be compliant with Federal firearms laws and regulations. UPDATE FLS: The licensee’s EIN is not listed in FLS. Pending DIO concurrence rcvd: A Warning Letter in lieu of a Warning Conference ( WL ILO WC ) without a recall inspection is recommended ( ROV Issued). - A compliance inspection was initiated on 1/13/2016 and completed on 1/25/2016 at the licensed premises in Camden, AL. The inspection disclosed six violations: 27 CFR 478.21(a) - redacted instances, item 30a was blank; 27 CFR 478.124(c)(1) - redacted instances; 27 CFR 478.124(c)(3)(i) redacted instances (21a, 21c & 21d errors or blank); 27 CFR 478.124(c)(4) - redacted instances; 27 CFR 478.124(c)(5) - redacted instances; and 27 CFR 478.125(e) - redacted instances (includes redacted missing/unreconciled firearms). Basis for alternate recommendation : only redacted of disposition errors occurred within the past twenty (20) years. Only redacted of the missing firearms was obtained during the past twenty (20) years (1996); the remainder were obtained between 1981 and 1988. The licensee stated he did not present the old A&D records during the previous inspection since the entries were more than twenty (20) years old. The DIO has reviewed the report and supporting documentation for this case and he concurs with the alternate recomendation of warning letter in lieu of warning conference. However, the DIO believes that a recall inspection should be conducted.
