Please conduct a Disposition Emphasis compliance inspection, to include a complete inventory and review of all ATF Forms 4473 available for the inspection period. Verify ownership, responsible persons status, and contact information. Document each finding, and enter all required information into N-SPECT .
An onsite unannounced compliance inspection was conducted by IOIs redacted and redacted for failure to mark redacted rifles that were manufactured and the corresponding entries tor them to be entered into the A&D record as such. IOI redacted recommends a warning letter in lieu of a warning conference. The rifles never entered commerce. The licensee also stated he was never instructed to mark rifles manufactured as proto types in previous inspections. No further action recommended. The acknowledgement was executed and all of the licensee’s questions were answered.
This inspection involved an inventory redacted firearms and the examination redacted ATF Forms 4473 . For the inspection period the license acquired and disposed of redacted and redacted firearms, respectively. The licensee failed to mark redacted manufactured rifles dating to 2012, and enter them into a bound book record. Based upon the licensee's immediate attention given to the matter and the fact that the rifles were maintained at the licensed premises as prototypes, I recommend an ROV and No Recall Inspection as the Order may allow, at the discretion of the DIO .
ATF O 5370.1C prescribes a warning conference for failure to mark firearms manufactured. I recommend a warning letter with no recall inspection as the most appropriate outcome because the operations poses very limited public safety risk, as evidenced by the lack of thefts, inventory losses, traces, or trafficking indicators. The licensee had not transferred from his possession any of the non-marked proto-type firearms and promptly corrected both violations during inspection.
