ATF F 5030.5, Report of Violations, issued. Investigator redacted recommends a Warning Letter Only and No Recall Inspection . In addition, Mr. Quaglia is requesting the following update to FLS: β’Frank M. Qualia III Title change from Co-Owner to Manager.
Concur with alternate recommendation of WL Only and No Recall Inspection . This licensee was educated on the requirements of reporting multiple sales and stated he would report them as required in the future. The licensee stated that this inspection was very thorough and that some of the violations for which he was cited had never been brought to his attention in prior inspections. Further, this licensee was committed to making sure his records were correct and he made templates for the ATF Form 4473 to prevent the violations cited during this inspection from reoccurring. He stated that this will also ensure that the ATF Form 4473 in its entirety is completed correctly. Lastly, licensee stated he would start double-checking the ATF F 4473s prior to firearms being transferred. The licensee also implemented the necessary internal controls to ensure his inventory accurate and that all firearms are timely logged into the A&D Record. This licensee has demonstrated that he is willing and able to comply with the regulations. All of the licensee's traces [b3 112 Public Law 55] were successful and there were no missing guns. Therefore, a WL and No Recall is th appropriate recommendation for this inspection.
