Firearms compliance inspection.
Two violations were disclosed. Revocation is recommended.
Inspection was initiated due to information that an anonymous person provided to the FFLC and Area Office that redacted was still the owner of the Rebel Pawn Shop. redacted previously held a FFL that was revoked by ATF and redacted appealed to the U.S. District Court (Middle Tennessee). The revocation was upheld by the Court. The U.S. District Court's ruling was appealed by redacted to the Court of Appeals. During the appeal a LLC was formed redacted son, Brian Shaffer (also an RP on redacted FFL) as a member, his wife and two employees. An application for a FFL was later received by the Nashville II Field Office for Rebel Pawn & Gun LLC. A recommendation was made by the IOI and Area Supervisor to deny this application. The DIO chose to issue the license based on documentation obtained from redacted attorney and advice given by ATF attorney redacted. After the license was granted, redacted withdrew his appeal to the Appellate Court. Current inspection disclosed evidence/information indicating that redacted is still financially involved in the operations of the business and should have been listed as an RP for this license on the application.
After a review of the narrative report and supporting documentation, redacted. However, hte policy review board in BHQ decided that no hidden ownership existed and they advised DIO Boydston to hold a DIO-Led Warning Conference. A DIO-Led Warning conference was held with this licensee on June 15, 2016, at ATFs Nashville FD.
