Licensee has not maintained an acquisition and disposition ( A&D ) record, potentially since 2009 when current license was issued. IOI redacted has afforded Rutherford time since initial meeting on December 2, 2016 to locate record; to date it cannot be found. He claims to not have held an A&D record, though prior reports disclose one existed as late as 2009. This license was the successor to a previous FFL held by Rutherford (FFL # 4-31-089-01-9C-13635). Neither it nor current license have had any traces; the last known transaction occurred in 2009 and that was the transfer of a firearm to Rutherford’s personal collection. Prior to that, the only other possible transaction of note occurred in 1999. This information has been gathered from previous reports and the recollection of Rutherford. Despite the violation and potential administrative action , Rutherford has refused to surrender despite his license only having approximately 17 months remaining and no aspirations of being engaged in the business in any way. Indeed, he only mentions maintaining the license to either A) ship his personal firearms (which IOI redacted explained he does not need a license for), or B) use to further any local political agendas in which he can comment his status as a "FFL" to denounce concealed carry or other firearm issues. Despite his refusal to recreate the book from his invoices and other paperwork, licensee’s lack of actual transactions and unlikelihood of future business activity a warning conference a futile venture. Quick review of invoices disclosed that Rutherford's last acquisition was in the 1990s; FFL has no current business inventory (all firearms on premises are personal inventory). IOI redacted has already stressed the sole violation; brining Rutherford in to speak to Area Supervisor or Director of Industry Operations ( DIO ) will not help with any further compliance. Recommend warning letter and recall inspection to ensure severity of not maintaining A&D record is addressed, also recommend that licensing center contact Area Office prior to allowing Rutherford to renew FFL in 2018.
