On November 16, 2015, Industry Operations Investigator redacted initiated an unannounced full Disposition Emphasis (DE) Inspection of the above referenced Federal Firearms Licensee ( FFL ). The responsible person and corporate president, Johnny Lwin, was present for the inspection; verified with a valid Florida driver’s license. The scope of the inspection included all licensed activities from November 17, 2014 through November 16, 2015. The licensee was cited with a violation of 27 CFR 478.99(c)(9) as a result. This is a REPEAT VIOLATION from the November 2012, November 2011, and October 2008 inspection. In redacted instance, the licensee conducted a transfer of a firearm to a purchaser, who at the time of the transfer appeared to be prohibited. The customer, redacted, for question 11i (misdemeanor crime of domestic violence) was marked “yes.”
Concur with recommendation of a warning letter and recall inspection . The FFL was cited for one REPEAT violation of 27 CFR 478.99(c)(9). The licensee transferred a firearm to an individual after answering 'Yes" to 11i (Misdemeanor Crime of Domestic Violence). The purchaser was not prohibited. A warning letter was sent certified mail, return receipt requested, on 05/02/16. The PII was completed on 05/02/16.
