CONDUCT FIREARMS DISPOSITION EMPHASIS INSPECTION FOR THIS TYPE 01 LICENSEE. REFER TO IO MANUAL, CHAPTER C, AND THE ANNUAL CLEVELAND GROUP III DOMAIN ASSESSMENT. THIS INSPECTION MUST BE COMPLETED DURING FY16 AS REQUIRED BY THE DOMAIN ASSESSMENT. PLEASE NOTE: THE LICENSEE ATTEMPTED TO CHANGE HIS BUSINESS FROM A SOLE PROPRIETOR TO AN LLC UNDER Ul#773030-2014-0417. LOCAL ZONING WOULD NOT ALLOW WITHOUT A LOCAL PERMIT. THE LICENSEE WITHDREW THAT APPLICATION. DETERMINE IF THE LICENSEE EVER FOLLOWED UP WITH LOCAL ZONING AND/OR HAS ANY FUTURE ASPIRATIONS OF CHANGING FROM A SOLE PROPRIETOR TO AN LLC.
On April 26, 2016, A/S redacted reviewed and concurred with the alternate recommendation of a Warning Letter ( WL ) and Recall in lieu of a Report of Violations ( ROV ) and Recall. The licensee was cited for one violation for not entering redacted firearms into his A&D records. All redacted were reported as "consignment" firearms. The licensee admitted during the inspection that he transferred/returned "consignment" firearms to the persons he obtained them from in the past without entering them in his A&D records and without doing an ATF Form 4473 ; however, no evidence existed to support a violation for not completing the ATF Form 4473 or doing a NICS background check. A WL does not minimize the violation cited and a Recall will ensure future compliance with the GCA and namely involving "consignment" transactions.
