Repeated similar violations rises to the level of "Warning Conference". An alternate Recommendation of Viols WL ONLY and No Recall Inspection is being made based upon the following: 1. Significant and number of Violations: 27 CFR 478.99(c)(9) – redacted form (Not a Prohibited Person) 27 CFR 478.126a – redacted occasions affecting five firearms 2. Time elapse since previous Administrative Action: May 7, 2008. I reviewed the compliance inspection report and the noted violations. Although the violations are repeat violations, the time since the previous Administrative Action has been over seven years and the number is incidents for the violations was greatly reduced. The licensee has improved and reduced the number of violations since the previous two compliance inspections. I concur with the recommnedation of the IOI for Violations, Warning Letter and no recall inspection of this licensee.
The inspection revealed four violations; however, two rose to the level of a warning letter for the violation of 27 CFR 478.99(c)(9) in redacted instance, and 27 CFR 478.126a in redacted instances for failure to report multiple handgun sales. These violations also warrant a warning conference as they are repeat violations from a compliance inspection May 7, 2008; however, based on the reduction in the number of instances, and the lapse of time since the last administrative action a recommendation of a warning letter with no recall inspection is decided.
