Date of Last Inspection: June 23, 2011 On September 18, 2017 ATF Industry Operations Investigators (IOIs) redacted Iinitiated an on-site full Disposition Emphasis (DE) Recall firearm compliance investigation at the licensed business premise of Robert Findlay Smith doing business as Original Magazine 2 located at 4128 Sicard Hollow Road, Birmingham, AL 35242. No other Federal, State or local agencies participated in this investigation. Robert Smith, Responsible Person was interviewed. Scope of investigation included but was not limited to a physical inventory reconciliation and review of records and reports for accuracy and completeness. The period of review for this investigation was 09/18/2017 to 09/22/2017. There was one (1) violation with three (3) parts cited. 27 CFR 478.125(e): Three (3) Parts Nature of violation (Part I): In HHH instances the licensee did not record the sale or other disposition of a firearm not later than 7 days following the date of such transaction. Nature of violation (Part II): ln redacted instance the licensee could not reconcile (locate) firearms annotated in his inventory. Nature of violation (Part III) "REPEAT": InH instances the licensee failed to record address and/or FFL on acquisition firearms in the A & D record. Repeat Violation from Compliance Inspection conducted July 07, 2009 through August 27, 2009.
Inspection Period: September 18, 2016 to September 18, 2017. Business profile: redacted firearm acquisitions and redacted firearm dispositions. There were 86 firearms on hand in physical inventory compared against 97 open A&D record entries. The Licensee failed to record the disposition of redacted firearms, of which redacted were reconciled andHH| was reported as missing inventory. Additionally, the Licensee failed to record the address and/or FFL in the A&Drecord forH firearm acquisitions, which was a repeat of violation cited 01/13/10. On 09/22/17, a Report of Violations was issued citing a violation of 27 CF™78.125(e). (Amended ROV issued 02/05/18 subsequent to clarifying business activities.). There wereMMB ATF Forms 4473 on file and reviewed for the period disclosing no violations.
