This inspection resulted in redacted violations redacted violations for failure to contact NICS or obtain a valid exception to NICS prior to transferring a firearm to a non-licensee redactedr. Cashdollar has had his license since 01/09/1986 and has had three compliance inspections in the past five years. Mr. Cashdollar has received warning letters in his past three consecutive inspections, two of which included a repeat of violation currently cited. However, for the current inspection, Investigator redacted found significant improvements with the licensee's execution/retention of ATF Forms 4473 and his acquisition and disposition records. An alternative recommendation of a warning letter and recall inspection is recommended.
Licensee has had three previous recall inspections which resulted in Warning Letters. Assignment 2013-0062 resulted in an alternate recommendation of a WL due to the following violations; 27 CFR 478.102(a) - redacted instance and 27 CFR 478.124(a) - redacted instance. The licensee was unable to find the ATF F 4473 . Assignment 2014-0120 resulted in a WL due to the following violations: 27 CFR 478.124(c)(1) redacted forms; 27 CFR 478.124 (c)(3)(i) - redacted forms; 27 CFR 478.124(c)(3)(iv) redacted forms; 27 CFR 478.124(c)(4) - redacted form; 27 CFR 478.124(c)(5) - 27 CFR 478.124(c)(4 forms; 24 CFR 478.125(e) - redacted instances. Assignment 2015-0271 resulted in an alternate recommendation of a WL due to 27 CFR 478.102(a) - redacted form (the licensee accepted an out of state FLCHL. The assignment also resulted in two additional violations: 27 CFR 478.124(c)(3)(iv) - redacted form and 27 CFR 478.125(e) - redacted instances. The current inspection resulted in one violation of 27 CFR 478.102(a) - redacted forms. redacted transactions involved redacted weapons. The licensee checked item 22 on the ATF F 4473 indicating a background check was not required because the transaction involved redacted. The violation of 27 CFR 478.102(a) is a repeat violation from two previous inspections with three different reasons for the error. The licensee has improved since the last inspection with no missing firearms, no A&D errors, no failure to report multiple sales , and no traces. An alternate recommendation of a WL and Recall inspection is recommended.
An inspection of South Texas Tripods & Feeders, Inc. warrants a recommendation of warning letter; however, because the licensee was cited for the same violation during its 2015 inspection, which warranted a warning conference, a warning conference is warranted for the repeat violation. Mr. Cashdollar has been reminded of his responsibility to conduct a NICS or obtain a valid alternative permit.
