A Report of Violations was issued and a Warning Letter (no recall ) is recommended in lieu of a Warning Conference due to the following mitigating factors: (1) Violation of 27 CFR 478.21(a) is a repeat violation: however, this violation occurred on only redacted occasions, which represents less than 1 % of the 952 forms reviewed for the inspection period of 06/27/15 through 06/27/16. (2) Violations of 27 CFR 478.99(c)(1) and 27 CFR 478.99(c) are repeat violations; however, each violation occurred on only redacted occasion, which represents less than 1% of the 952 forms reviewed for the inspection period of 06/27/15 through 06/27/16. NCIC queries were conducted on each purchaser with no prohibiting information disclosed. (3) Violation of 27 CFR 478.124(c)(1) is a repeat violation; however, this violation occurred on only redacted occasions, which represents less than 1% of the 952 forms reviewed for the inspection period of 06/27/15 through 06/27/16. (4) Violation of 27 CFR 478.126a, in redacted instances, is a repeat violation; however, each instance involved the purchase of a single handgun by the same individual on redacted separate occasions within 5 business days. Licensee was operating from the standpoint that the form was only required on the sale of more than 1 handgun to the same individual on the same business day. (5) Licensee has created and recently began using an “ATF 4473 Checklist” to assist employees in completing the ATF Form 4473. The form provides for a secondary review of the ATF Form 4473 by another employee, excluding the seller, in order to prevent future violations.

I have reviewed the investigative report and the violations as a result of the inspection I concur with the recommendation of the IOI for a ROV , WL and No Recall Inspection ILO a Warning Conference.
DIO Concurs with recommendation of a WL ILO WC as three violations rose to the level of an administrative action involving a WL; however, as repeat violations, they also warrant a WC. Proceed with WL as the violations were minimum in the number of instances in the midst of nearly 1,000 4473 transactions reviewed.
