Violation #2 meets the criteria for a Warning Letter to be issued under paragraph #6.c.(13) of The ATF Firearms Administration Action Policy (ATF O 5370.IB). None of the individuals involved in the violation were prohibited from receiving firearms. No recall inspection is recommended due the intermittent nature of the licensee's business and expressed willingness to comply going forward. The licensee submitted a Notice during the inspection to remove redacted as a Responsible Person under the license.
JUSTIFICATION The inspection meets the standard for Warning Letter under the Administrative Action Policy (2/8/2013). The licensee was cited for redacted instances of failing to conducted a NICS check - Warning Letter at Sec 6.c.13. redacted of the buyers were law enforcement officers. The licensee claimed the redacted buyer held a Kansas CCW, however, Block 23 was blank. Subsequent background checks on each of the buyers were negative.
