CONDUCT FULL COMPLIANCE INSPECTION.
Report of Violations, Warning Letter, Recall Inspection IOI recommends a Warning Letter be issued to the FFL in lieu of a Warning Conference. The licensee was issued FFL on SeptemDer24, 2014, however the licensee did not begin conducting business with this license until June 2016. The licensee and key employees were educated on ATF regulations and requirements. The licensee demonstrated a willingness to comply with ATF regulations that govern his firearms business.
In redacted instances, the licensee failed to timely record the disposition of firearms; in redacted instance, the licensee failed to initiate a new Form 4473 and conduct NICS , instead the licensee added a firearm to a form 4473 for a transaction that was completed the previous day; in redacted instances, the licensee failed to verify and record proper identification information; in redacted instance, the licensee transferred a hand gun to an out-of-state resident. This is the first compliance inspection for this licensee since being licensed in September 2014. There were 358 firearms in inventory. There were 95 ATF Forms 4473 on file, redacted firearms acquired and redacted firearms disposed during the inspection period. The licensee and employees were provided training during the closing conference. Note: Violation #7 citation was amended and now reflects 27 CFR 478.99(a). This change was addressed in the WL sent on 10/7/16.
Because this was the licensee's first compliance inspection since obtaining the FFL in 2014 and the licensee did not commence the firearms portion of the business until June 2016, I concur with the Investigator and Area Supervisor's alternate recommendation of Warning Letter and Recall inspection .
