Report of Violations, Warning Letter, No Recall Inspection The violations for which the licensee was cited during this inspection would warrant a Warning Conference; however, an alternate recommendation of Warning Letter and No Recall Inspection is recommended due to the following circumstances: 1 )Although the violations for which the licensee was cited during this inspection are repeat violations, the overall firearms business has improved and the number of instances of violations has significantly reduced (less than 1 % of all firearms transactions conducted by the licensee during the inspection period contained errors/omissions). 2)The licensee stated that during the course of their business coming under new management, and their recent move to a new location, the disruption of their normal business operations may have been the cause of the firearms not being properly logged out. The licensee stated they are certain that the firearms were either transferred to another dealer, or that the ATF Form 4473 has been misplaced. The licensee stated they will continue to search for the disposition of the firearms through invoices/receipts, and completed ATF Forms 4473. 3)Finally, the violations for which the licensee was cited during this inspection do not appear to be willful in nature. The licensee is very committed to ensuring compliance with ATF’s requirements and regulations, and stated he will strive to ensure more thorough reviews are conducted of all firearms transactions.

Reviewed the inspection report and further discussed the noted violations with the IOI All of the violations would warrant a WL , however due to them being Repeat Violations, the recommended After Action would be for a WC . The number of incidents for the violations was reduced from the previous inspection The FFL relocated to a different business premise and has hired a new manager who is focused on the firearms transfers and is working on elminating the violations from subsequent inspections I concur with the recommendation of the IOI for an alternate recommendation for ROV WL Only and No Recall Inspection.
DIO concurs with the recommendation of a WL ILO a WC based on the following Although all four violations were repeat violations, the FFL improved significantly since the last investigation in 2015 where 14 violations were discovered Additionally, the violations reduced in the number of forms or guns involved in the incident. For violation 27 CFR 478.21(a), the number of forms involved reduced from redacted to redacted; for violation 27 CFR 478.124(c)(1), the number of forms reduced from redacted to redacted; for violation 27 CFR 478.124(c)(3)(iv), the number of forms reduced from redacted to redacted, and for 27 CFR 478125(e), the number of untimely dispositions reduced from redacted guns to redacted guns.
