Document, "ATF FIELD OPERATIONS - FY2016 CODING GUIDELINES" p7: Recall investigations for final dispositions recommendations of DIO WC i/l/o/ Revocation, WC , WL , and ROV must be submitted to the AS in NSPECT within two years from the onsite end date of the assignment that generated the recall. The last compliance investigation resulted in a warning letter in lieu of a warning conference.
A Warning Letter is recommended in lieu of a Warning Conference. The licensee’s last inspection resulted in a Warning Letter in lieu of a Warning Conference. The licensee was cited for 10 violations, eight (8) of which are repeats from the last inspection. The licensee had 1,611 ATF Forms 4473 on file for the inspection period with violations disclosed on a total of redacted forms. The licensee's last inspection rose to the level of a Warning Conference due to five unreported multiple sales transactions. Though cited for this violation again, the licensee only had redacted instance of an unreported multiple sale.
Out of ten (10) violations cited during the current examination, eight (8) violations were repetitive in nature. Only redacted instance of one (1) repeat violation appears to warrant a warning conference due to the licensee failing to report redacted multiple handgun sale. Additionally, all cited violations had a very low rate of occurance. Therefore, a warning letter is recommended in lieu of a warning conference. Due to the fact that the licensee stated that they were too busy to double check the accuracy of their ATF Forms 4473 prior to transferring firearms, a recall inspection is recommended.
