Failure to file multiple sales reports when legally required redacted or more instances. redacted instances cited involving redacted firearms. Failure to timely and/or correctly record the required disposition entries for less than five (5) percent (4.6% redacted times) of the total redacted dispositions. Failure by the licensee to obtain complete and accurate information for any items on the Forms 4473 certification section on less than five (5) percent (0.8%) of the forms. Investigator redacted recommends WL and Recall Inspection in lieu of WC . The licensee failed to report redacted multiple sales; however, the licensee was not cited for this violation (478.126a) during the previous inspection ending on 9/27/06. IOIs reminded the licensee of the requirements to file the ATF Form 3310.4 multiple sale reports during the closing conference held on 11/30/16. Mr. Cohen stated that he forgot about the requirements. Mr. Cohen said that he understands and he will comply with the requirements for all future transactions that require ATF Form 3310.4. The licensee had all ATF Forms 4473 on file and corrected all redacted untimely recorded dispositions in the A&D Record. There were no missing firearms.
WL and recall recommended due redacted muliple handgun forms not filed - FFL said he forgot about having to file multiple handgun forms. Also FFL had late disposition of firearms - but no missing firearms.
DIO concurs with the Lead IOI and Area Supervisor for a Warning Letter and Recall Inspection , in lieu of a Warning Conference and Recall Inspection. The inspection merited a warning conference based on teh fact that the FFL failed to file multiple sales reports, ATF F3310.11, when legally required redacted or more instances. The FFL failed to file redacted) multiple handgun forms involving redacted) firearms during the review period 10/31/15 - 10/31/16. During this inspection redacted multiple sales were filed and these regulations were thoroughly reviewed with the licensee who assured futured compliance. The previous compliance inspection of this FFL in 2006, did not cite multiple sale violations but did result in a Warning Letter, with no recall due to 4.7% error rate on the ATF Forms 4473 . This inspection disclosed that the FFL improved on the accuracy of the ATF Forms 4473. In addition, the licensee properly accounted for their firearms physical inventory.
