A review of the licensee’s inventory revealed redacted manufactured lower receivers containing only Roman letters for the serial number ATF directives state that the serial number must be a combination of Roman letters and Arabic numerals, or solely Arabic numbers. The licensee failed to identify redacted manufactured firearms in accordance with ATF requirements and was cited for violation of 27 CFR 478.92(a)(1)(i). Per ATF O 5370.1C, failure to mark manufactured firearms appropriately warrants a warning conference. However, Investigator redactedrecommends a warning letter in lieu of the warning conference since all manufactured firearms contained the required markings, with exception of the serial number formatting of redacted firearms.
The licensee was cited for 5 violations including 27 CFR 478.92(a)(1 )(i) for failing to properly mark firearms manufactured on redacted occasions - the FFL marked receivers with serial numbers that were not alpha numeric (the receivers were only serialized with a formal name™ Per ATF O 5370.1 C this violation merits an Area Supervisor warning conference as the minimum AA . However, the FFL stated they did not understand the requirements for serialization (which is not explicitly outlined in the regulation). Additionally, all other receivers and assembled firearms were serialized according to established guidelines. The licensee was also cited for failing to report the theft / loss of firearms to ATF on a single occasion which warrants a WL per ATF O 5370.1 C. As such as warning letter without recall is recommended.
Issuing a warning letter is lieu of holding a warning conference is authorized. A recall inspection will not be conducted. This is the licensee's first inspection since the license was issued in 2013. The licensee failed to properly mark redacted firearms manufactured. The licensee only used Roman letters and did not use Roman and Arabic characters or only Arabic characters when marking the firearms with serial numbers. This rises to a warning conference level. The responsible transferred redacted were corrected and the proper markings were included. Other violations were cited. The licensee failed to report multiple sales involving firearms rising to a report of violation only. The licensee also failed to report the theft or loss of redacted firearms after a theft/loss in 2015. (The firearms were reported to local law enforcement but not to ATF.) During this inspection period, the licensee has acquired approximately redacted firearms and disposed of approximately redacted firearms. For this inspection, the licensee failed to enter redacted firearms found in inventory in the acquisition and disposition record ( A & D Record) and failed to record the disposition of redacted firearms reported to local law enforcement as a theft/loss. redacted firearm was missing after reconciliation, with no disposition found. This equals a T6.7% error rate for the acquisitions and a 24.0% error rate for dispositions. The A & D Record errors rise to a report of violation only for the current inspection as it was fewer than redacted instances, however, the redacted missing firearm rises to a warning letter level. A warning conference is not necessary to again explain how to properly mark firearms with either both Roman and Arabic characters or only Arabic characters, given this has been corrected moving forward. Further, a warning conference is not necessary to again explain how to complete multiple sales, reporting requirements for both local law enforcement and ATF; and the importance of maintaining an accurate A & D Record. The licensee is aware of the obligations. All the violations and the corrective actions was discussed at the closing conference. A warning letter will suffice to document the licensee may want to consider additional internal controls to prevent repeated violations regarding marking firearms properly, A & D Record errors, theft/loss reporting and multiple sales. Note, a recall inspection is not recommended as, again, all violations were explained during the closing conference and the licensee is aware of the requirements. It is believed the RP will continue to improve with his compliance.
