It is the recommendation of IOI redacted that a Warning Conference be conducted along with a Warning Letter and a Recall Inspection based upon the following criteria: •Yakima Arms, Inc. has been subject to a Warning Letter and Recall Inspection and the current inspection warrants a Warning Conference due to the Repeat of Violations from 2013. •27 CFR 478.21(a) Forms Prescribed (Repeat of Violation 2013). On redacted forms the licensee accepted and/or failed to accurately complete the Firearms Transaction Records (ATF Forms 4473 ). On redacted Transaction Records the type of firearm being transferred was left blank or incorrectly recorded (Item #18). On redacted Transaction Records the recertification signature was left blank (Item #24). On redacted Transaction Records the recertification date was left blank or incorrectly recorded (Item #25). On redacted Transaction Record the licensee failed to indicate (2 instead of TWO) the total number of firearms transferred (Item #30A). •27 CFR 478.99(b) Certain Prohibited Sales or Deliveries The licensee transferred firearms earlier than the 10 business day wait according to Washington State Law. On redacted occasion the licensee transferred a firearm earlier than the 10 business day wait according to Washington State Law. This lead to firearms being transferred to redacted possible prohibited persons. •27 CFR 478.102(b) Sale or Deliveries of firearms on and after November 30, 1988 (State is Point of Contact) On redacted occasions the licensee failed to record the required National Instant Criminal Background Check ( NICS ) where the State is recognized as a point of contact for NICS checks. The licensee failed to accurately record NICS information in items number 21a-21d. •27 CFR 478.124(b) Firearms Transaction Record The licensee failed to retain the Firearms Transaction Records (ATF Forms 4473) in a manner prescribed by the regulations. The licensee was filing the transaction records according to the line, book and page number of the firearm in the A/D record. When the firearm transaction record was denied, this resulted in the transaction records not being filed alphabetically by purchaser’s name, chronologically by date of disposition or numerically by transaction serial number. •27 CFR 478.124(c)(1) Firearms Transaction Record (Repeat of Violation 2013) On redacted forms the licensee accepted the Firearms Transaction Records (ATF Forms 4473) with blank or incomplete responses by the transferee. On redacted occasions the licensee accepted the Firearms Transaction Record with incomplete responses to transferee's first or middle name (Item #1). On redacted occasions the licensee accepted the Firearms Transaction Record with an incomplete response to the physical address, an incorrect abbreviated county, with “Yak”, “WA” ‘U.S.’ or 'USA' or an incorrect response to the State “WN” or “CA” (Item #2). On redacted occasions the licensee accepted the Firearms Transaction Record which contained an incorrect response to the transferee’s state of birth (Item #3). On redacted occasion the licensee accepted Firearms Transaction Record with a blank or incorrect response to the Certification Signature (Item #16). On redacted occasions the licensee accepted the Firearms Transaction Record with a blank or incorrect response to the Certification Date (Item #17). •27 CFR 478.124(c)(3)(i) Firearms Transaction Record (Repeat of Violation 2013) The licensee failed to accurately record the transferee's identification on the Firearms Transaction Records (ATF Forms 4473). On redacted occasions the licensee failed to record or correctly record the Alternate Documentation (Item #20b). •27 CFR 478.124(c)(3)(iv) Firearms Transaction Record (Repeat of Violation 2013) On redacted forms the licensee failed to record complete and accurate NICS information in Items #21a, Items #21b, Items #21c and/or items #21d on the Firearms Transaction Records (ATF Forms 4473). The licensee failed to record the date NICS was contacted (Item #21a). The licensee failed to record or incorrectly recorded the NICS Transaction Number (Item #21b). The licensee failed to record the initial response from NICS (Item #21c). The licensee failed to record the date of the follow-up response from NICS after initially receiving a delayed response (item #21d). •27 CFR 478.124(c)(4) Firearms Transaction Record (Repeat of Violation 2013) On redacted forms the licensee failed to properly record the required firearm information (Items #26, 27, 29 & 30) on the Firearms Transaction Records (ATF Forms 4473). On redacted Transaction Record the licensee failed accurately record the type of firearm being transferred (Item #29). On redacted Transaction Record the licensee failed to accurately record the caliber or gauge of the firearm being transferred (Item #30). •27 CFR 478.124(c)(5) Firearms Transaction Record (Repeat of Violation 2013) On redacted forms the licensee failed to record the date the firearm was transferred/item #36) on the Firearms Transaction Records (ATF Form 4473). On redacted occasions the licensee failed to accurately record the date the firearm was transferred (Item #36). •27 CFR 478.125(e) Records Maintained by Dealers (Repeat of Violation 2013). The licensee failed to accurately record the acquisition or disposition of redacted firearms in the A & D record. On redacted occasion the licensee recorded the firearm as logged out when in inventory. On redacted occasions the licensee failed to record the serial numbers correctly. •27 CFR 478.126(a) Forms Prescribed (Repeat of Violation 2013) On redacted occasions the licensee failed to report or timely report the multiple sales or other disposition of pistols and revolvers on the Firearms Transaction Records (ATF Form 4473). On redacted occasions involving redacted handguns the licensee failed to submit the multiple sales or other disposition of pistols and revolvers (ATF Form 3310.4). On redacted occasions involving redacted handguns the licensee failed to timely submit the multiple sales or other disposition of pistols and revolvers (ATF Form 3310.4) report when two or more handguns were sold to an individual within five consecutive business days.
An inspection was conducted to determine if the licensee is operating in compliance with Federal Firearms Laws and regulations. The inspection disclosed violations for failing to obtain properly completed Firearms Transaction Records and failing to obtain an accuate A & D Record. The inspection documented redacted instances where the licensee failed to submit the Report of Multiple Sales . The licensee filed the missing forms. Due this violation and the recall status, a warning conference is warranted. However, the licensee may have had repeat violations, the records were substancially improved since the 2013 inspection. For this reason, it is recommended that Warning Letter be issued with no further action.
